California Consumer Privacy Act (CCPA) Disclosure and Notice at Collection

Effective: 10/30/2025

Resurgent Funding LLC ("RFUN") is a financial institution as defined by U.S. Code Ann. 15 § 6809(3)(A) (the U.S. Gramm-Leach-Bliley Act ("GLBA")) and, in the course of business, its master servicer, Resurgent Capital Services ("RCS"), may collect data from you. Because it is a financial institution under the GLBA, RCS takes all measures required by the GLBA to protect the privacy of your data.

California Consumer Privacy Act Disclosure

This California Consumer Privacy Act Disclosure ("CCPA Disclosure") supplements the Privacy Policy for RCS. This CCPA Disclosure applies solely to California consumers, including personnel working on behalf of our business partners (e.g., vendors) (collectively, "B2B individuals"), subject to the exception listed below. For clarity, this CCPA Disclosure applies to personal information RCS, as master servicer of RFUN, collects about California consumers, both on the website and offline.

This CCPA Disclosure does not apply to:

  • Information RCS, as master servicer of RFUN, collects, processes, or discloses subject to the GLBA and its implementing regulations or the California Financial Information Privacy Act. If you have a financial product or service with us, RCS, as master servicer of RFUN will use and share the personal information that RCS collects from or about you in accordance with RCS's Privacy Notice, which offers you certain choices with respect to the use and sharing of your personal information.

This CCPA Disclosure uses certain terms that have the meaning given to them in the California Consumer Privacy Act of 2018 (the "CCPA"), as amended by the California Privacy Rights Act of 2020, and its implementing regulations.

Accountholders: If you have an account with us through which RCS, as master servicer of RFUN, provides you with a financial service, this CCPA Disclosure does not apply to you. RCS, as master servicer of RFUN, uses and shares any information that it collects from or about you in accordance with the RCS Privacy Notice.

Non-Accountholders: If you are not a B2B individual as defined above and you do not have an account with us, and if RCS, as master servicer of RFUN, does not otherwise have contact information on file about you, then there is no reasonable method by which RCS can verify your identity as required by CCPA. This is because RCS does not link information it may collect about non-account holders (e.g., IP addresses, device identifiers or other information collected through automated means) to named actual persons. Accordingly, if you do not have an account with us and if RCS, as master servicer of RFUN, does not otherwise have contact information on file about you, and you request access to, or correction or deletion of, your personal information, RCS, as master servicer of RFUN, will not be able to process your request.
